End User License Agreement

This End User License Agreement (“Agreement”) is between you and NEXTPIXEL APPS LLP only, and not with Apple Inc. (“Apple”), for the Video AI iOS app (the “App”). NEXTPIXEL APPS LLP, not Apple, is solely responsible for the App and its content. By downloading, installing, or using the App, you agree to this Agreement, the Terms of Service, and the Privacy Policy. If you do not agree, do not use the App.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as allowed by the App Store terms.

2. Prohibited uses

You agree not to use the App:

• To create, upload, generate, or share illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content
• To violate any law or the rights of others, including copyright, privacy, or publicity rights
• To generate nude, sexual, pornographic, or otherwise sexually explicit content
• To generate content that depicts or promotes violence, hatred, or harm
• To upload photos of other people without permission, or to create misleading deepfakes or impersonate someone without consent
• To create sexual content involving anyone 17 or under

We may suspend or terminate access if you break these rules.

3. Content ownership

You own the photos and prompts you submit and the videos generated from them. You grant us a worldwide, non-exclusive, royalty-free license to use that content only to operate the App. You are responsible for what you create and share.

4. Review before sharing

AI output can be unexpected. Review every video before you share it. You are responsible for making sure the result is appropriate and lawful.

5. Disclaimer and liability

The App is provided as is. NEXTPIXEL APPS LLP is not liable for damages from your use of the App, including offensive or inaccurate output. See the Terms of Service for the full limitation of liability.

6. Termination

We may end this Agreement and your access at any time, including for violations. You may stop using the App at any time. App Store subscriptions must be cancelled in your Apple ID settings.

7. Changes

We may update this Agreement. The date at the top will change when we do. Continued use after an update is acceptance of the new Agreement.

8. Apple as third-party beneficiary

You and NEXTPIXEL APPS LLP acknowledge that Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement, and that upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary. Apple has no obligation to provide maintenance or support for the App. To the maximum extent permitted by law, Apple has no warranty obligation for the App. NEXTPIXEL APPS LLP, not Apple, is responsible for addressing any claims relating to the App or your possession and use of it, including product-liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer-protection, privacy, or similar laws. If a third party claims the App or your possession and use of it infringes that party’s intellectual property rights, NEXTPIXEL APPS LLP, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim.
